Good morning. Today is July 23, 2011. It is approximately 66 years after the Japanese surrender ceremonies in Taiwan on Oct. 25, 1945. At that time, apparently, to many people in the world community, it was not exactly clear the legal significance of the Japanese surrender ceremonies, and indeed in later directives, memoranda, and other legal papers issued by the United States Executive Branch, the significance of these surrender ceremonies was not entirely recognized. In fact it should be 100% clear that based on the Hague Regulations of 1907, "Territory is considered occupied when it is actually placed under the authority of the hostile army." Oct. 25, 1945, therefore marks the beginning of the military occupation of Formosa and the Pescadores. This is despite the fact that at that time, there were many other declarations and proclamations floating around, and very much in everyone's consciousness, such as the Cairo Declaration, the Potsdam Proclamation, and certain statements made in the Japanese surrender documents of Sept. 2, 1945.

In dealing with occupied territory, there are three central questions which must be dealt with. (1) When did the occupation begin? (2) Who is the occupying power? (3) When did the occupation end? It has perhaps only been in the last decade or so that many of the departments of the US Executive Branch have come to realize the significance of Oct. 25, 1945, as the beginning of the military occupation of Taiwan. At the same time more and more researchers and scholars involved in the Taiwan issue have also begun to recognize that this is the beginning of the military occupation of Taiwan.


在處理被佔領土方面，有三個核心問題，必須加以處理。 （1）佔領是什麼時候開始的？ （2）誰是佔領權國？ （3）佔領是什麼時候結束的？現在是2011年，大概只有在過去這十年左右，美國行政部門的很多單位，才開始了解到1945年10月25日的意義，係為台灣地區軍事佔領的開始。同時，越來越多參與了台灣問題研究的研究人員和學者也開始認知到，當天是台灣地區軍事佔領的開始。

Nevertheless, these people are not familiar enough with the customary laws of warfare of the post-Napoleonic period to be able to delve into a discussion of the other two questions. Therefore they immediately make the incorrect assumption that somehow the Republic of China is "the occupying power" in Taiwan, and perhaps, through various democratic changes over the past twenty or more years, perhaps Taiwan has already left, has already terminated a situation of military occupation. These two types of considerations are incorrect.


然而，這些人不夠熟悉拿破崙時代後的戰爭慣例法來探索其他兩個問題的答案。因此，他們立即做出不正確的假設，不知怎麼地，以為中華民國是在台灣的“佔領權國”，而且由於在過去 20多年，通過各種民主變革，大概也許台灣已經離開並終止軍事佔領的情況。這兩種假設是不正確的。

During the WWII period, all military attacks against targets in Formosa and the Pescadores were made by the United States military forces, the United States suffered the loss of many men, military vessels on the high seas, and also aircraft, in culminating with the result that the Japanese flag in Taiwan was lowered. Therefore under the customary laws of warfare it is the United States of America which will be the occupying power of Taiwan. As we see, the military occupation was handled by the Republic of China military forces, thus resulting in a principal - subordinate relationship. This relationship is fully recognized by the San Francisco Peace Treaty of 1952. Article 23(a) specifies the United States of America is the principal occupying power. At the same time we know that military government is the form of administration by which an occupying power exercises governmental authority over occupied territory. And Article 4(b) of the San Francisco Peace Treaty gives the United States Military Government jurisdiction over Taiwan, in a similar fashion that it was given jurisdiction over the Ryukyu Island Group.


在美日太平洋戰爭期間，所有攻打台灣和澎湖的軍事行動，都是美軍所為，美國損失大量軍人、軍艦及戰機，最後，日本國旗在台灣下降。因此，根據戰爭慣例法美國必定為台灣的佔領權國。如我們所看到的，中華民國﹝蔣介石﹞的軍隊是來處理台灣軍事佔領的任務，從而導致了一個委任與被委任或說主從關係。這個關係完全被1952年的舊金山和平條約認可。事實上，1952年的舊金山和平條約裡頭，第23條（a）指明美國是主要佔領權國。同時我們知道，軍事政府是佔領軍對於佔領地區執行政府職權的管理當局型態。舊金山和平條約裡頭，第4條（b）使美國軍事政府對台灣有管轄權，以類似的方式，與其被賦予琉球群島的管轄權一樣。

At the same time we see that Article 2(b) announces that Japan renounces all right, title, and claim to Formosa and the Pescadores, thus resulting in a situation where Japan gave up her authority over these islands but no "receiving country" was specified. As a result, Taiwan remains under the jurisdiction of the United States Military Government as an interim status condition. There has been nothing which has happened from the period of 1952 when the San Francisco Peace Treaty came into force up to the present day which has changed this situation. The United States remains as the principal occupying power over Taiwan territory up to the present day.


同時我們看到，第2條（b）指出，日本放棄對台灣、澎湖等島嶼的一切權利、權利名義與要求，從而導致的情況是日本放棄了對這些島嶼的權利，但沒有指定“收受國”。因此，台灣仍在美國軍事政府的管轄下為一個暫定狀況。從1952年舊金山和平條約生效到今天，沒有發生什麼事情改變了這種局面。美國至今仍然是台灣地區的主要佔領權國。

Therefore, although regrettably 66 years late, we are raising the United States flag over Taiwan territory, and at this point I must offer my humble apologies to the Taiwanese people for our lateness in taking this action. However, we assume that in the future, these matters will proceed more smoothly. Therefore we are making arrangements for Taiwan to be separated into Six States, and to begin issuance of United States authorized ID cards. So, today I want to offer my thanks to all the members of the Cabinets of the Six States, as well as our central government Cabinet, all of our officers and members of the Taiwan Civil Government Senate, and the Senates of the Six States, as well as all of our supporters and other representatives who have joined us here today to celebrate this historic occasion.

So, I hope that in the future we can spread our influence to all corners of Taiwan, and in some way make sure that the Taiwanese people can realize the guarantees under the US Constitution which are rightfully theirs as an overseas territory of the United States under military government, and at the most basic level of course those are the guarantees of the Fifth Amendment: life, liberty, property, and due process of law.


所以，我希望在未來我們可以繼續傳播我們的影響力，到台灣的各個角落，並以適當的方式確保台灣人民能夠了解做為美國軍政府管轄下海外領土所應有的美國憲法保障。當然，至少，這些都是第五修正案：「生命，自由，財產和正當法律程序」的保證。
